MCDAL CORPORATION PRIVACY POLICY (2026)
1. ABOUT THIS PRIVACY POLICY
McDal Corporation (“McDal,” “we,” “us,” or “our”) is a Pennsylvania-based provider of crane, hoist and industrial lifting equipment, parts, installation, inspection and repair services. Our customers are businesses and commercial entities — not consumers. This Privacy Policy explains how we collect, use, protect and handle information obtained through our website at mcdal.com and in connection with our commercial operations.
This Policy is effective as of August 26, 2026, and supersedes all prior versions, including the version previously posted on mcdal.com, dated May 25, 2018.
1.1. Relationship To Commercial Terms And Conditions
If you are a current or prospective commercial customer of McDal, your relationship with McDal is governed primarily by McDal’s Terms and Conditions of Sale and Purchase (v.062326) (the “Commercial T&Cs”), available at mcdal.com/terms. In the event of any conflict between this Privacy Policy and the Commercial T&Cs, the Commercial T&Cs shall control. Specifically, and without limitation:
- Limitation of Liability: All claims arising out of or related to this Privacy Policy, including any claim arising from a data security incident, are subject to the limitation of liability and exclusion of consequential damages set forth in Section 18 of the Commercial T&Cs.
- Governing Law and Forum: All disputes arising out of or related to this Privacy Policy shall be governed by Pennsylvania law and resolved exclusively in the state courts of Montgomery County, Pennsylvania or the United States District Court for the Eastern District of Pennsylvania, as set forth in Section 23 of the Commercial T&Cs.
- Jury Trial Waiver: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE ARISING OUT OF OR RELATED TO THIS PRIVACY POLICY SHALL BE RESOLVED WITHOUT A JURY. EACH PARTY IRREVOCABLY WAIVES ANY RIGHT TO A JURY TRIAL IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS PRIVACY POLICY OR ANY DATA COLLECTED IN CONNECTION WITH McDAL’S COMMERCIAL OPERATIONS.
- Notices: Any formal privacy-related complaint or notice from a commercial customer shall be submitted in writing in accordance with Section 22 of the Commercial T&Cs. Telephone inquiries do not constitute formal notice and do not trigger any dispute resolution timeline under the Commercial T&Cs.
- Informal Dispute Resolution: Before commencing any litigation related to a privacy claim, commercial customers and McDal shall attempt in good faith to resolve the dispute through informal negotiation between senior representatives for a period of at least thirty (30) days, consistent with Section 23(d) of the Commercial T&Cs.
2. INFORMATION WE COLLECT
2.1. Information You Provide To Us
In connection with our commercial operations, we collect information that customers, prospective customers, vendors, suppliers and website visitors provide directly to us, which may include:
- Contact information: Name, title, business name, business address, telephone number and business email address.
- Transaction information: Details related to requests for quotes, proposals, purchase orders, invoices and payments, including equipment specifications, project requirements and pricing information.
- Payment information: Credit card information and banking details provided for payment processing. Payment information is processed through secure third-party payment processors and is not stored on McDal’s systems beyond what is required to complete the transaction.
- Communications: Emails, voicemails and other correspondence you send to McDal in connection with sales inquiries, service requests, warranty claims or disputes.
- Website account credentials: Username and password if you create an account on mcdal.com.
2.2. Information We Collect Automatically
When you visit mcdal.com, our servers and analytics tools may automatically collect certain non-identifying technical data, including:
- IP address and general geographic location derived from IP address
- Browser type and version
- Operating system
- Pages visited, time and date of visit and time spent on each page
- Referring URL
This technical data is used solely to maintain and improve the functionality of the website and to understand aggregate traffic patterns. It is not used to identify individual visitors for commercial sales purposes without your knowledge.
2.3. Information We Do Not Collect
McDal does not collect and has no legitimate business purpose to collect from commercial customers or website visitors: government identification numbers (including Social Security numbers, passport numbers or driver’s license numbers), medical information, biometric data or financial account information beyond what is necessary to process a specific payment transaction. If you believe McDal has inadvertently collected such information, please contact us immediately using the contact information at the end of this Policy.
3. HOW WE USE INFORMATION
McDal uses the information we collect for the following purposes:
- To fulfill commercial transactions: Processing quotes, proposals, purchase orders, invoices, deliveries, installations, inspections and service requests.
- To manage the customer relationship: Communicating with you about your orders, service status, warranty claims, invoices and account standing.
- To enforce our Commercial T&Cs: Including pursuing collection of past-due amounts, enforcing security interests and asserting or defending claims under the indemnification and limitation of liability provisions of the Commercial T&Cs.
- To comply with legal obligations: Retaining business records as required by applicable law, responding to lawful legal process and cooperating with regulatory authorities where required.
- To improve our website and operations: Using aggregated, anonymized technical data to diagnose website issues and improve user experience.
- To communicate about our services: Sending customers information about McDal’s products, services and promotions that may be of interest based on the customer’s existing commercial relationship with McDal.
3.1. Limitations on Marketing Use
Commercial proposal and transaction data is confidential. Consistent with Sections 2 and 21 of the Commercial T&Cs, information contained in or derived from a confidential proposal, quote, pricing schedule, drawing, specification or design is McDal’s confidential commercial information. Such information shall not be used for general marketing communications to third parties and shall not be disclosed to any third party without the express written consent of the party to whom the proposal was addressed. McDal’s marketing communications to existing customers are limited to information about McDal’s own services and are not based on disclosure of confidential proposal or transaction data to outside marketing partners.

4. HOW WE SHARE INFORMATION
McDal does not sell, rent or trade customer information to third parties for their own marketing purposes. We may share information in the following limited circumstances:
- Service providers: We engage third-party vendors to assist with payment processing, IT systems, website analytics, accounting and legal services. These vendors are permitted to access customer information only as necessary to perform their specific functions on McDal’s behalf and are contractually prohibited from using that information for any other purpose.
- Legal and regulatory compliance: We may disclose information as required by law, regulation or valid legal process, including court orders, subpoenas or regulatory investigations. We will provide reasonable notice to affected parties before disclosure where permitted by law.
- Business transfers: In the event of a merger, acquisition, sale of substantially all assets or similar transaction, customer information may be transferred to the successor entity, provided that the successor entity assumes obligations no less protective than those set forth in this Policy.
- Protection of rights: We may disclose information where reasonably necessary to enforce the Commercial T&Cs, protect McDal’s legal rights, prevent fraud or protect the safety of McDal’s personnel, customers or the public.
- With your consent: We may share information for any other purpose with your prior written consent.
5. DATA SECURITY
McDal maintains commercially reasonable administrative, technical and physical safeguards designed to protect the information we collect from unauthorized access, disclosure, alteration and destruction. These measures include secure network configurations, access controls and employee training on data handling practices.
NOTWITHSTANDING THE FOREGOING, NO METHOD OF ELECTRONIC TRANSMISSION OR STORAGE IS COMPLETELY SECURE. McDAL DOES NOT WARRANT OR GUARANTEE THE ABSOLUTE SECURITY OF ANY INFORMATION TRANSMITTED TO OR STORED BY McDAL. IN THE EVENT OF A DATA SECURITY INCIDENT AFFECTING YOUR INFORMATION, McDAL’S LIABILITY SHALL BE SUBJECT TO THE LIMITATION OF LIABILITY SET FORTH IN SECTION 18 OF THE COMMERCIAL T&Cs AND SHALL IN NO EVENT INCLUDE CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL or PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS OR BUSINESS INTERRUPTION DAMAGES.
McDal will notify affected commercial customers of a confirmed data security incident involving their confidential business information within a commercially reasonable period following McDal’s confirmation of the incident, consistent with applicable law.
6. DATA RETENTION
6.1. General Retention Practices
McDal retains personal and business information only for as long as necessary to fulfill the purposes for which it was collected, to comply with applicable legal obligations and to resolve disputes and enforce agreements.
6.2. Business Records Retention Carve-Out
Notwithstanding any general data minimization or deletion practice, McDal shall retain all records — including customer contact information, transaction records, proposal and pricing data, correspondence, payment records and dispute-related communications — for the following minimum periods, which are consistent with the survival provisions of the Commercial T&Cs:
- Confidential commercial information (§2 of Commercial T&Cs): Minimum three (3) years following the expiration or termination of the applicable commercial relationship.
- Work product and technical documentation (§21 of Commercial T&Cs): Minimum five (5) years following the expiration or termination of the applicable commercial relationship.
- Records related to indemnification claims (§17 of Commercial T&Cs): Minimum three (3) years following Substantial Completion of the applicable Work or the expiration of the applicable statute of limitations for bodily injury claims, whichever is longer.
- Payment and financial records: Minimum seven (7) years following the transaction, consistent with standard accounting and tax retention obligations.
- Records subject to a litigation hold: Indefinitely until the hold is released by McDal’s legal counsel.
Deletion requests do not override these retention obligations. If a commercial customer requests deletion of their information and such information is subject to a retention obligation under the Commercial T&Cs, applicable law or an active or reasonably anticipated legal proceeding, McDal will retain the information for the required period and notify the requesting party accordingly. Upon expiration of all applicable retention periods, McDal will delete or anonymize the information within a commercially reasonable timeframe.
7. YOUR RIGHTS AND CHOICES
Commercial customers and website visitors may exercise the following rights with respect to their information held by McDal:
- Access: You may request confirmation of whether McDal holds information about you and request a summary of that information.
- Correction: You may request correction of inaccurate or incomplete information.
- Deletion: You may request deletion of your information, subject to the business records retention obligations described in Section 6 above.
- Opt-out of marketing: You may opt out of receiving promotional communications from McDal at any time.
To exercise any of these rights, please submit a written request to McDal using the contact information provided at the end of this Policy. McDal will respond to verifiable requests within thirty (30) days. For complex or numerous requests, McDal may extend this period by an additional thirty (30) days with notice to the requesting party.
McDal will verify the identity of the requesting party before fulfilling any access, correction or deletion request. McDal will not fulfill requests that would require deletion of information subject to a retention obligation or that would compromise McDal’s ability to enforce the Commercial T&Cs or defend against a legal claim.
8. CALIFORNIA PRIVACY RIGHTS
If you are a California resident with an established business relationship with McDal, the California Consumer Privacy Act (Cal. Civ. Code §§ 1798.100 et seq.) (“CCPA”) and the California Privacy Rights Act (“CPRA”), as amended, may provide you with additional rights regarding your personal information.
8.1. Categories Of Personal Information Collected
In the preceding twelve (12) months, McDal has collected the following categories of personal information as defined by the CCPA: identifiers (name, address, email, phone number, IP address); commercial information (transaction records, purchasing history, proposals); and internet or other electronic network activity information (website usage data).
8.2. No Sale Or Sharing Of Personal Information
McDal does not sell personal information and does not share personal information with third parties for cross-context behavioral advertising purposes. McDal has not sold or shared personal information in the preceding twelve (12) months.
8.3. Your CCPA Rights
California residents may have the right to: (i) know what personal information McDal has collected and how it is used and shared; (ii) delete personal information, subject to the retention obligations described in Section 6; (iii) correct inaccurate personal information; (iv) opt out of the sale or sharing of personal information (not applicable, as McDal does not sell or share); and (v) non-discrimination for exercising CCPA rights.
To submit a CCPA request, please contact McDal using the information at the end of this Policy. McDal will respond within forty-five (45) days as required by the CCPA, with a possible extension of an additional forty-five (45) days where reasonably necessary.
8.4. Authorized Agent
A California resident may designate an authorized agent to submit a CCPA request on their behalf. McDal will require written proof of authorization and may verify the identity of both the resident and the agent before fulfilling the request.
9. COOKIES AND WEBSITE TRACKING
9.1. Cookies We Use
This website mcdal.com uses the following categories of cookies:
- Essential cookies: Required for basic website functionality, including session management and secure login. These cannot be disabled without impairing website functionality.
- Performance cookies: Used to collect anonymous, aggregated data about how visitors use the website, including pages visited and time spent. This data is used solely to improve website performance and user experience.

11. CHANGES TO THIS POLICY
McDal may update this Privacy Policy from time to time to reflect changes in our business practices, legal obligations or the Commercial T&Cs. Material changes will be posted on mcdal.com with an updated effective date. For registered users of mcdal.com, McDal will provide notice of material changes by email to the address on file. Continued use of mcdal.com or McDal’s services following the effective date of a revised Policy constitutes acceptance of the revised Policy.
If any change to this Privacy Policy conflicts with the Commercial T&Cs then in effect, the Commercial T&Cs shall control until the Commercial T&Cs are updated to reflect the change.
12. GOVERNING LAW; FORUM; JURY TRIAL WAIVER
This Privacy Policy is governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or related to this Privacy Policy shall be brought exclusively in the state courts of Montgomery County, Pennsylvania or the United States District Court for the Eastern District of Pennsylvania. Each party irrevocably submits to the exclusive personal jurisdiction of such courts and waives any objection to venue on grounds of inconvenient forum or otherwise.
EACH PARTY IRREVOCABLY WAIVES ANY RIGHT TO A JURY TRIAL IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS PRIVACY POLICY. THIS WAIVER IS KNOWING AND VOLUNTARY.
